Quá trình thực hiện nhiệm vụ quản lý hành chính, tố tụng, thi hành án người thi hành công vụ khi gây ra thiệt hại cho cá nhân, tổ chức thì trách nhiệm bồi thường được quy định như thế nào ?

1/ Luật trách nhiệm bồi thường của nhà nước năm 2009

2/  Nghị định 16/2010/NĐ-CP ngày 03/3/2010 hướng dẫn Luật Trách nhiệm bồi thường của Nhà nước 

3/ Thông tư liên tịch số 05/2012/TTLT-VKSNDTC-TANDTC-BCA-BTP-BQP-BTC-BNN&PTNT ngày 02 tháng 11 năm 2012 hướng dẫn thực hiện trách nhiệm bồi thường của nhà nước trong hoạt động tố tụng hình sự

–            Thông tư liên tịch số: 01/ttlt-vksndtc-tandtc-bca-btp-bqp-btc-bnn&ptnt sửa đổi, bổ sung một số điều của thông tư liên tịch số 05/2012/ttlt-vksndtc-tandtc-bca-btp-bqp-btc-bnn&ptnt ngày 02 tháng 11 năm 2012 hướng dẫn thực hiện trách nhiệm bồi thường của nhà nước trong hoạt động tố tụng hình sự

6/ Thông tư liên tịch 17/2015/TTLT-BTP-BQP ngày 07 tháng 12 năm 2015 hướng dẫn thực hiện trách nhiệm bồi thường của Nhà nước trong hoạt động thi hành án dân sự

7/ Thông tư liên tịch số 18/2015/TTLT-BTP-BTC-TTCP ngày 14 tháng 12 năm 2015 hướng dẫn thực hiện trách nhiệm bồi thường của Nhà nước trong hoạt động quản lý hành chính

Đối tượng được bồi thường thiệt hạiTrách nhiệm bồi thường

Khi cá nhân, tổ chức bị thiệt hại về vật chất, tổn hại về tinh thần do người thi hành công vụ gây ra trong hoạt động quản lý hành chính, tố tụng, thi hành án thì được nhà nước bồi thường.

Người bị thiệt hại có quyền yêu cầu cơ quan có trách nhiệm bồi thường giải quyết việc bồi thường.

Cơ quan có trách nhiệm bồi thường thiệt hại

1.         Trong hoạt động quản lý hành chính

Cơ quan hành chính trực tiếp quản lý người thi hành công vụ có hành vi trái pháp luật gây ra thiệt hại là cơ quan có trách nhiệm bồi thường.

2.         Trong hoạt động tố tụng

–            Trong hoạt động tố tụng hình sự: Cơ quan điều tra, cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra trong hoạt động tố tụng hình sự; Viện kiểm sát nhân dân trong hoạt động tố tụng hình sự; Toà án nhân dân trong hoạt động tố tụng hình sự

–            Trong hoạt động tố tụng dân sự, tố tụng hành chính: Toà án nhân dân trong hoạt động tố tụng dân sự, tố tụng hành chính

3.      Trong hoạt động thi hành án

–         Trong hoạt động thi hành án hình sự: Cơ quan có trách nhiệm bồi thường trong hoạt động thi hành án hình sự là trại giam, trại tạm giam, cơ quan quản lý nhà tạm giữ, cơ quan công an có thẩm quyền và Toà án ra quyết định thi hành án.

–         Trong hoạt động thi hành dân sự: Cơ quan có trách nhiệm bồi thường trong hoạt động thi hành án dân sự là cơ quan thi hành án dân sự trực tiếp quản lý người thi hành công vụ có hành vi trái pháp luật gây ra thiệt hại.

Căn cứ xác định trách nhiệm bồi thường

Việc xác định trách nhiệm bồi thường của Nhà nước trong hoạt động quản lý hành chính, tố tụng dân sự, tố tụng hành chính, thi hành án phải có các căn cứ sau đây:

Có văn bản của cơ quan nhà nước có thẩm quyền xác định hành vi của người thi hành công vụ là trái pháp luật và thuộc phạm vi trách nhiệm bồi thường.

Có thiệt hại thực tế do hành vi trái pháp luật của người thi hành công vụ gây ra đối với người bị thiệt hại: Thiệt hại thực tế được bồi thường là thiệt hại có thực mà người bị thiệt hại phải gánh chịu, bao gồm: thiệt hại về vật chất và thiệt hại do tổn thất về tinh thần. 

Có mối quan hệ nhân quả giữa thiệt hại thực tế xảy ra và hành vi trái pháp luật của người thi hành công vụ. 

 Việc xác định trách nhiệm bồi thường của Nhà nước trong hoạt động tố tụng hình sự phải có các căn cứ sau đây:

Có bản án, quyết định của cơ quan nhà nước có thẩm quyền trong hoạt động tố tụng hình sự xác định người bị thiệt hại thuộc các trường hợp được bồi thường.

Có thiệt hại thực tế do người tiến hành tố tụng hình sự gây ra đối với người bị thiệt hại: Thiệt hại thực tế được bồi thường là thiệt hại có thực mà người bị thiệt hại phải gánh chịu, bao gồm: thiệt hại về vật chất và thiệt hại do tổn thất về tinh thần. 

Thời hiệu yêu cầu bồi thường

Thời hiệu yêu cầu bồi thường là 2 năm  kể từ ngày cơ quan nhà nước có thẩm quyền ban hành văn bản xác định hành vi của người thi hành công vụ là trái pháp luật hoặc kể từ ngày bản án, quyết định có hiệu lực pháp luật của cơ quan tiến hành tố tụng hình sự xác định người bị thiệt hại thuộc trường hợp được bồi thường

Thời hiệu yêu cầu bồi thường trong quá trình khiếu nại hoặc khởi kiện vụ án hành chính được xác định theo quy định của pháp luật về khiếu nại, tố cáo và pháp luật về thủ tục giải quyết các vụ án hành chính. Trong quá trình giải quyết khiếu nại, giải quyết vụ án hành chính đã xác định hành vi trái pháp luật của người thi hành công vụ và có thiệt hại thực tế mà việc bồi thường chưa được giải quyết thì thời hiệu yêu cầu bồi thường là 02 năm.

Thiệt hại được bồi thường

Thiệt hại do tài sản bị xâm phạm

Thiệt hại do thu nhập thực tế bị mất

Thiệt hại do tổn thất về tinh thần

Thiệt hại về vật chất do người bị thiệt hại chết

Thiệt hại về vật chất do thiệt hại về sức khỏe

Trả lại tài sản

Khôi phục lại danh dự cho người bị thiệt hại trong hoạt động tố tụng hình sự

Quyền và nghĩa vụ của người bị thiệt hại

Người bị thiệt hại có quyền sau đây:

Yêu cầu Nhà nước bồi thường thiệt hại, khôi phục danh dự;

Được cơ quan có trách nhiệm bồi thường hoặc Tòa án giải quyết và thông báo việc giải quyết bồi thường;

Khiếu nại, tố cáo quyết định, hành vi trái pháp luật của người có thẩm quyền trong việc giải quyết bồi thường theo quy định của pháp luật về khiếu nại, tố cáo;

Khiếu nại, kháng cáo bản án, quyết định của Toà án theo quy định của pháp luật tố tụng;

Yêu cầu cơ quan, tổ chức có thẩm quyền khôi phục quyền, lợi ích hợp pháp của mình.

Người bị thiệt hại có nghĩa vụ sau đây:

Cung cấp kịp thời, đầy đủ và trung thực tài liệu, chứng cứ có liên quan đến yêu cầu giải quyết bồi thường;

Chứng minh về thiệt hại thực tế đã xảy ra.

Рассмотрим рационально-практическую сторону каждого из типов, их определения и различия.

    Ключевым типом в этой системе является Генератор. Он отличаются высокой энергетичностью и способностью легко и эффективно завершать начатые задачи. Их природа требует постоянной активности, поэтому важно находить дело, которое по-настоящему нравится. Генератор начинает действовать, когда ощущает внутренний отклик. Их индивидуальная особенность заключается в том, что энергия накапливается, только когда они следуют своему отклику.

    Второй тип — это Манифестор. Этот тип уникален своей независимостью и способностью инициировать действия. Они не нуждаются в отклике, как Генераторы, и могут сразу принимать решения и действовать. Различие этого типа в том, что они лучше всего проявляют себя, когда свободны от ограничений. Главная их практическая задача — инициировать изменения.

    Также важный элемент системы Дизайна Человека — Проектор. Проекторы лучше всего проявляют себя в роли наблюдателей и стратегов. Они нуждаются в приглашении, прежде чем начать действовать, и могут эффективно использовать энергию, когда работают с другими людьми. Проекторы отличаются тем, что не обладают собственной энергией, но могут эффективно направлять энергию других. Их рациональное предназначение – это оптимизация работы других типов.

    Четвертый тип в Дизайне Человека — это Рефлектор. Этот тип является самым редким и уникальным. Они, как зеркало, отражают общее состояние общества или коллектива. Их рациональная роль заключается в объективной оценке происходящего вокруг.

    Итак, подведем итог: Каждый из четырех типов в Дизайне Человека имеет свои индивидуальные особенности, которые помогают им максимально эффективно взаимодействовать с миром. Понимание своего типа и его практического предназначения позволяет лучше организовать жизнь, выбрать правильные направления для работы и улучшить качество личных отношений.
