Thưa Luật sư !
Tôi là công nhân xây dựng, vừa rồi trong quá trình làm việc tôi và người phụ trách có xảy ra mâu thuẫn, người phụ trách đó xúc phạm và còn dọa đuổi việc tôi trước nhiều người. Tôi cảm thấy mình bị oan ức nên sau khi tan làm rồi đã tìm gặp người phụ trách đó và lúc đầu tôi chỉ đập chiếc xe máy cũ mà người đó đang đi nhưng khi anh ta xúc phạm tôi và trong lúc tôi không kiềm chế được tôi đã đánh anh ta bị thương (tỉ lệ thương tích là 15 %). Tôi đã xin lỗi nhưng anh ta không đồng ý và nói sẽ gửi đơn cho công an để yêu cầu khởi tố.
Luật sư cho tôi hỏi trường hợp này liệu tôi có phải ngồi tù không ?

Với tỷ lệ thương tật lên là 15% gây ra cho nạn nhân, thì hành vi của bạn có dấu hiệu tội “Cố ý gây thương tích” theo quy định tại Khoản 1, Điều 104 Bộ luật hình sự. Theo đó, “Người nào cố ý gây thương tích hoặc gây tổn hại cho sức khỏe của người khác mà tỷ lệ thương tật từ 11% đến 30% hoặc dưới 11% nhưng thuộc một trong các trường hợp sau đây, thì bị phạt cải tạo không giam giữ đến ba năm hoặc phạt tù từ sáu tháng đến ba năm”.
Tại Điều 105 Bộ luật tố tụng hình sự thì Cơ quan cảnh sát điều tra chỉ được quyền khởi tố vụ án, khởi tố bị can trong trường hợp có đơn yêu cầu của người bị hại. Bởi vậy, nếu có đơn yêu cầu của người bị hại thì CQĐT mới khởi tố vụ án, khởi tố bị can. Đối với trách nhiệm dân sự bạn có thể phải bồi thường khoản tiền tương ướng với chiếc xe mà bạn đã làm hỏng của người bị hại.
