Làm thế nào để ly hôn với chồng/vợ mất tích nhiều năm không có tin tức là một trong những câu hỏi được nhiều người thắc mắc. Vậy có ly hôn được không và thủ tục trình tự được thực hiện như thế nào ?
Với thắc mắc như trên, Luật Thái Minh trả lời như sau:
– Có thể thực hiện việc ly hôn với người vợ/chồng đã mất tích.
– Trình tự, thủ tục được thực hiện theo các bước:
Bước 1: Đương sự thực hiện các thủ tục để Tòa tuyên bố vợ/chồng mất tích (nếu đã có Quyết định tuyên bố mất tích của Tòa thì không cần thực hiện thủ tục này)
Bước 2: Sau khi đã có Quyết định của Tòa tuyên bố vợ/chồng mất tích, đương sự sẽ nộp hồ sơ ly hôn tại Tòa.
Hồ sơ gồm:
+ Giấy đăng ký kết hôn (bản chính)
+ CMND hoặc hộ chiếu (bản sao có chứng thực)
+ Giấy khai sinh của các con (bản sao có chứng thực)
+ Bản sao hộ khẩu thường trú, tạm trú
+ Đơn xin ly hơn
+ Giấy tờ chứng minh về tài sản
