Thưa Luật sư ! Xin Luật sư giải đáp cho tôi vấn đề sau:
Tôi vào làm việc tại Công ty được hơn hai năm, mọi năm Công ty đều thưởng tết nhưng năm nay Giám đốc nói sẽ không có khoản thưởng tết cho công nhân viên (CNV) như hàng năm nữa. Vậy việc không thưởng tết cho CNV như công ty tôi có đúng theo quy định pháp luật không ?

Hiện nay chưa có văn bản pháp luật nào quy định cụ thể về quy chế thưởng tết. Do đó, việc trả tiền thưởng tết âm lịch không phải là quy định bắt buộc doanh nghiệp phải thực hiện mà chỉ là khuyến khích người sử dụng lao động nên có chế độ đãi ngộ tốt nhất cho người lao động để họ tích cực tăng năng suất.
Tiền thưởng tết âm lịch sẽ dựa trên cơ sở thỏa thuận của người sử dụng lao động với người lao động thông qua hợp đồng lao động, thỏa ước lao động tập thể. Quy chế thưởng do người sử dụng lao động quyết định và công bố công khai tại nơi làm việc sau khi tham khảo ý kiến của tổ chức đại diện tập thể lao động tại cơ sở.
Theo Điều 103 Bộ luật lao động năm 2012: “Tiền thưởng là khoản tiền mà người sử dụng lao động thưởng cho người lao động căn cứ vào kết quả sản xuất kinh doanh hằng năm và mức độ hoàn thành công việc của người lao động”
Như vậy, đối với trường hợp trên, bạn cần xem xét trong hợp đồng lao động của bạn với công ty có thỏa thuận về việc thưởng tết cuối năm hay không; hoặc Quy chế thưởng đã được công bố tại nơi làm việc? Ngoài ra bạn cũng cần xem xét thêm các yếu tố như kết quả sản xuất kinh doanh hàng năm của công ty và mức độ hoàn thành công việc của mình để làm căn cứ xác định việc Công ty không trả thưởng bạn là đúng hay sai.
