Ngày 19/5/1993, cơ quan CSĐT công an tỉnh Bình Thuận phát hiện xác bà Dương Thị Mỹ (SN 1955, trú tại thôn 2, xã Tân Minh, huyện Hàm Tân, Bình Thuận) trong vườn điều nhà ông Hai Hoàng tại thôn 2, xã Tân Minh, huyện Hàm Tân. Qua quá trình điều tra, cơ quan điều tra xác định: Đây là vụ án giết người do mâu thuẫn tình ái. Tuy nhiên, do không làm rõ được thủ phạm, nên đến tháng 9/1993, cơ quan CSĐT công an tỉnh Bình Thuận đã ra quyết định tạm đình chỉ điều tra.
Khi vụ án đã chìm vào quên lãng thì đến ngày 23/4/1998, tại thôn 2, xã Tân Minh, huyện Hàm Tân lại xảy ra vụ “giết người và cướp tài sản công dân”, nạn nhân là bà Lê Thị Bông. Cơ quan CSĐT công an tỉnh Bình Thuận tiến hành điều tra và làm rõ thủ phạm là Huỳnh Văn Nén. Trong những ngày bị giam giữ tại trại tạm giam, Huỳnh Văn Nén đã khai báo với cơ quan điều tra về vụ án “vườn điều”. Theo lời khai của Huỳnh Văn Nén: Do biết chuyện bà Dương Thị Mỹ có quan hệ bất chính với Trần Văn Sáng (chồng của Nguyễn Thị Nhung), nên Nguyễn Thị Nhung đã tổ chức, cầm đầu những người trong gia đình gồm mẹ, các em ruột, con ruột và em rể (tổng cộng 9 người) ra tay giết Dương Thị Mỹ tại vườn điều nhà ông Hai Hoàng. 9 người có liên quan trong vụ án nổi tiếng trên gồm: Nguyễn Thị Nhung (SN 1957); Nguyễn Thị Lâm (1937, trú tại thôn 2, xã Tân Minh, mẹ của Nhung), Nguyễn Văn Sơn (tức Bé, SN 1965, trú tại Xuân Hòa, Xuân Lộc, Đồng Nai, em ruột Nhung), Nguyễn Thị Cẩm (SN 1966, trú tại thôn 2, xã Tân Minh, em ruột Nhung), Nguyễn Văn Tiền (SN 1968, trú tại thôn 4, xã Tân Minh, em ruột Nhung), Nguyễn Thị Tiến (SN 1973, trú tại thôn 2, xã Tân Minh, em ruột Nhung), Huỳnh Văn Nén (SN 1962, chồng của chị Cẩm), Trần Thanh An (SN 1977, con ruột Nhung), Trần Thanh Vân (tức Tý, SN 1979, con ruột Nhung).
Đánh giá lời khai của Nén phù hợp với hiện trường, do vậy ngày 12/12/1998, cơ quan CSĐT công an tỉnh Bình Thuận đã phục hồi điều tra vụ án giết người, cướp tài sản của bà Dương Thị Mỹ và lần lượt ra các quyết định khởi tố bị can. Ngày 20/11/1999, phó thủ trưởng CQĐT công an tỉnh Bình Thuận là trung tá Đinh Kỳ Đáp đã ký bản kết luận điều tra vụ án giết người cướp tài sản công dân.
Theo hồ sơ vụ án do CQĐT công an tỉnh Bình Thuận thu thập: Khoảng đầu năm 1993, Trần Văn Sáng (SN 1959, trú tại xã Tân Minh, huyện Hàm Tân, Bình Thuận) có quan hệ tình ái với bà Dương Thị Mỹ. Khoảng 9h ngày 18/5/1993, Nhung giặt quần áo cho chồng thì phát hiện trong túi quần của chồng có một tờ giấy với nội dung: “Mỹ muốn gặp Sáng vào 1h đêm nay tại vườn điều ông Hai Hoàng”.Nguyễn Thị Nhung ghen tức và đã cùng gia đình tổ chức đánh ghen, dẫn đến cái chết của Dương Thị Mỹ.
Tại bản án hình sự sơ thẩm số 22 ngày 7/3/2001, TAND tỉnh Bình Thuận đã xử phạt bà Lâm 10 năm tù; anh Sơn 8 năm tù; anh Tiền 8 năm tù; chị Tiến 6 năm 6 tháng tù; anh Sáng 3 năm tù và Huỳnh Văn Nén 6 năm tù về tội “giết người”. Riêng Huỳnh Văn Nén buộc chấp hành án tù chung thân trong vụ án bà Bông. Trước đó, chị Nguyễn Thị Nhung bị bệnh chết, TAND tỉnh Bình Thuận đã ra quyết định đình chỉ vụ án đối với chị Nhung; Vân; An và Cẩm được Viện KSND tỉnh Bình Thuận miễn truy cứu trách nhiệm hình sự. Trừ Huỳnh Văn Nén, tất cả những người còn lại đều kháng cáo và kêu oan
Bản án sơ thẩm của TAND tỉnh Bình Thuận (lần thứ 2) đã tuyên phạt các bị cáo về tội giết người với mức án: Nguyễn Thị Lâm (7năm tù), Nguyễn Văn Sơn và Nguyễn Văn Tiền ( 6 năm tù), Nguyễn Thị Tiến (5 năm tù). Riêng Huỳnh Văn Nén, ngoài việc phải chấp nhận mức án 5 năm trong vụ án này, Nén còn phải thụ mức án chung thân trong vụ trước, tổng cộng hình phạt là chung thân và rút quyết định truy tố của Viện kiểm sát đối với bị cáo Nguyễn Thị Tiến về tội cướp tài sản công dân.
Bị cáo đầu tiên được thẩm vấn là Huỳnh Văn Nén. Tại phiên toà sơ thẩm (lần 1) tháng 12/2000, Nén khai nhận tội.
Tuy nhiên tại phiên toà phúc thẩm (lần 1) tháng 6/2001, Nén gây sốc ngay buổi khai mạc bằng lời khai “khi bà Mỹ bị giết, tôi đang làm thuê cho bác Chín Chè ở Xuân Lộc, Đồng Nai, hoàn toàn không tham gia và không biết vụ giết bà Mỹ”. Chính do lời khai này, Hội đồng xét xử (HĐXX) phúc thẩm đã tuyên huỷ bản án sơ thẩm (lần 1), trả hồ sơ cho cơ quan điều tra.
Sau đó trong trại giam Nén lại khai nhận tội. Tại phiên toà sơ thẩm (lần 2) tháng 7/2004, Nén kêu oan. Đến phiên phúc thẩm lần 2, Nén vẫn tiếp tục kêu oan, khai rằng những lần khai nhận tội trước đó là do bị điều tra viên bức cung, mớm cung.
Trong buổi thẩm vấn chiều 9/3/2004, bác Nguyễn Văn Mạnh (Chín Chè) và con trai là Nguyễn Hoàng Tài đều khai trong thời gian bà Mỹ bị giết, Nén đang làm thuê cho gia đình.
Về việc này, con dâu bác Chín Chè là Nguyễn Thị Bích Tuyền và anh Nguyễn Văn Tuấn khai không biết ai là Nén làm thuê cho gia đình. Anh Tài khai thêm, khi anh Tuấn có việc gia đình phải nghỉ, anh mới thuê Nén nên Tuấn không biết Nén. Chị Tuyền xác nhận, khi anh Tuấn nghỉ thì vợ chồng chị cũng không ở với bác Chín Chè nữa.
Đây là tình tiết rất quan trọng, ảnh hưởng đến toàn bộ diễn biến phiên xử và bản chất vụ án. Do vậy sau giờ nghỉ giải lao, HĐXX phúc thẩm và đại diện VKSND Tối cao giữ quyền công tố tại Toà đã tập trung thẩm vấn bị cáo Nén và các nhân chứng quanh việc sử dụng thời gian của Nén tháng 5/1993, khi xảy ra vụ án.
Anh Tài khai rằng, thời gian đầu gia đình anh có nhiều chuyện buồn (mẹ chết, anh trai và chị gái chết), anh phải lo làm ăn nuôi gia đình nên không muốn dính líu nhiều đến vụ này, sợ mất thời gian. Sau thời gian suy nghĩ, thấy lương tâm thôi thúc nên phải khai lại cho đúng sự thật…
* Bước ngoặt của vụ án
Kêu oan ở Bình Thuận không ăn thua, gia đình các bị can với sự giúp đỡ của luật sư đã viết đơn cầu cứu các nơi. Một trong những địa chỉ mà gia đình gửi đơn là ông Nguyễn Quốc Thước, đại biểu Quốc hội đoàn Nghệ An. Sau khi xem xét kỹ lưỡng đơn kêu cứu từ gia đình các bị can, ngày 18-12-2000, ông Thước đã có thư gửi Viện trưởng Viện KSND Tối cao, xin trích nguyên văn nội dung:
“Kính gửi: Đồng chí Viện trưởng VKSND Tối cao
Tôi nhận được một lá thư ngỏ về việc oan sai của 10 công dân vô tội ở Bình Thuận (gửi đến các đồng chí lãnh đạo Đảng, Nhà nước và cá nhân tôi). Tuy đã gửi tới các đồng chí lãnh đạo nhưng thấy sự việc liên quan đến các cơ quan pháp luật và nếu như những nội dung trong thư là đúng theo tinh thần của Quốc hội và ý kiến đồng chí Viện trưởng tại các kì họp cần được xem xét, nếu sai thì phải được minh oan, do vậy tôi xin chuyển đến đồng chí Viện trưởng để cho kiểm tra xác minh và có kết luận (chắc chắn hồ sơ đã có tại quý Viện).
Vừa qua có nhiều đơn khiếu nại nhưng khi cơ quan pháp luật cấp trên xem xét vẫn cứ lấy những chứng cứ cũ của cơ quan xét xử cấp dưới mà đương sự cho là chứng cứ giả (không thật), đương sự không được xuất trình chứng cứ chứng minh sự đúng đắn của khiếu nại nên sau khi có kết luận, trả lời, đương sự vẫn tiếp tục khiếu nại. Do vậy, đề nghị đồng chí Viện trưởng khi xem xét lại, cần cho đương sự trình bày những chứng cứ thật (theo đương sự) để đối chứng, kết luận”.
Bức thư ông Thước gửi tới Viện KSND Tối cao ít nhiều đã có tác dụng. Để rồi thời gian sau đó, các bị can được tạo điều kiện đưa ra các chứng cứ mới tại tòa nhằm bác bỏ những chứng cứ mà họ cho là giả, bị ép phải nhận. Đây có thể nói là bước ngoặt trong hành trình giải oan của các bị can trong “Kỳ án vườn điều”.
* Di nguyện của người chết mong được minh oan.
Sau mười bốn tháng bị cơ quan tiến hành tố tụng tạm giam, chị Nguyễn Thị Nhung mắc bệnh hiểm nghèo ung thư tử cung, được đưa vào Bệnh viện Ung bướu TP Hồ Chí Minh chữa trị. Trong quá trình điều trị, bệnh viện phát hiện trong người chị Nhung có vô số bệnh khác, mà tất cả những bệnh ấy đều khó chữa. Trả lời câu hỏi của các phóng viên về nội dung kết luận điều tra, chị Nhung cho biết: “Không đời nào có chuyện chồng tôi ngoại tình với bà Mỹ. Nếu anh ấy phụ bạc tôi thì thiếu gì người mà lại quan hệ với người đàn bà có 7 con, đã có dâu, rể lại kém nhan sắc? Còn nói tôi giặt quần áo cho chồng rồi phát hiện lá thư bà Mỹ gửi là chuyện bịa đặt”. Sau một thời gian điều trị, biết mình không qua khỏi, chị Nhung viết bản chúc thư để lại, nội dung đầy trách móc:
“Tôi tên Nguyễn Thị Nhung (SN 1957, trú tại xóm 4, thôn 2, xã Tân Minh, huyện Hàm Tân, tỉnh Bình Thuận). Nay tôi bị bịnh ung thư tử cung đang nằm điều trị tại Bệnh viện Ung bướu TP Hồ Chí Minh. Trước đây cơ quan CA điều tra tỉnh Bình Thuận bắt oan sai, tạm giam tôi tại CA tỉnh, cán bộ điều tra đã dùng biện pháp bức cung, nhục hình, tra tấn, đánh đập tôi tàn bạo, dã man trong trại giam. Do điều kiện sinh hoạt, tôi mắc phải bịnh ung thư tử cung, nay sức khỏe tôi bị suy kiệt, hơi thở sắp lụi tàn, tôi diết (viết – tác giả) di chúc nầy để lại toàn bộ cho người thân trong gia đình. Trước khi tôi nhắm mắt xuôi tay, kính gửi cha mẹ ruột, cha mẹ chồng, nội ngoại, người thân và chồng Trần Văn Sáng thực hiện nguyện vọng của tôi như sau
(trích):Tài sản gia đình trước đây đã bán nhà, đất, xe để đi kiện, nay còn lại phải vơ vét toàn bộ dù nghèo, đói, rách, chồng tôi Trần Văn Sáng và toàn bộ người thân trong gia đình cũng phải đội đơn đến Quốc hội gặp lãnh đạo cao nhứt để minh oan giải quyết cho tôi, khi đó linh hồn tôi mới siêu thoát, thanh thản ra đi”.
Khi chị Nhung sắp mất, bệnh viện trả về cho gia đình, bà con trong vùng kéo đến thăm hỏi, cho tiền, gạo, rau, thịt, hoa quả. Chị Nhung mất, suốt một ngày đêm, người trong xã mà đặc biệt là dân thôn 1, thôn 2 không sót gia đình nào là không đến phúng.
Chị Nhung mất được bảy ngày thì ông Đinh Kỳ Đáp, Phó Thủ trưởng CQĐT CA tỉnh Bình Thuận, và cán bộ điều tra là ông Cao Văn Hùng đến thăm, có tiền phúng điếu và đưa thư chia buồn.
* Câu chuyện tại phiên tòa.
– Bị cáo tố cán bộ điều tra.
Sau khi có 3 bản kết luận điều tra bổ sung, từ ngày 27-7 đến ngày 6-8-2004, TAND tỉnh Bình Thuận mở phiên tòa xét xử các bị cáo trong vụ án vườn điều. Tại phiên tòa sơ thẩm lần này, bị cáo Huỳnh Văn Nén, Nguyễn Thị Lâm, người liên quan Trần Thanh Vân khai rằng: Những lời khai trước đó là do điều tra viên (ĐTV) Cao Văn Hùng mớm cung, dùng nhục hình buộc họ phải khai theo lời khai của ĐTV này. ĐTV Cao Văn Hùng bác bỏ hoàn toàn những lời khai nêu trên của các bị cáo. Ông Hùng giải trình như sau:
Thứ nhất: Nếu bịa đặt ra vụ việc để buộc cả một gia đình vào tù nhằm mục đích lập công, để được cấp trên khen thưởng, thì theo quy định của ngành chỉ được cấp một bằng khen cộng với khoản tiền thưởng 50.000 đồng, đây là việc quá nhỏ để làm một việc bất nhân, thất đức như vậy.
Bị cáo nhận quyết định trả tự do từ cơ quan tiến hành tố tụng
Thứ hai: Nếu là vì vụ lợi, vì tiền cũng không có, vì gia đình nạn nhân là một gia đình quá nghèo, cơm không đủ ăn, áo không đủ mặc, các con của nạn nhân đều thất học thì làm gì có tiền mà lo lót.
Thứ ba: Nếu là vì tư thù cá nhân lại càng không. Trước đây, ông Hùng cùng một số ĐTV của PC16 khi xuống địa bàn điều tra thường ghé vào nhà bị cáo Nguyễn Thị Lâm ăn nghỉ. Chính Nguyễn Thị Lâm và Nguyễn Thị Nhung (vợ Sáng) còn nấu cơm cho các ĐTV ăn thì không có lí do gì lại căm thù họ để dựng chuyện bắt họ vào tù.
Tại phiên tòa này, HĐXX cho phát lại đoạn băng ghi hình lời khai của Nguyễn Thị Lâm và Trần Thanh Vân để làm tài liệu tham khảo thì Nguyễn Thị Lâm cho rằng có việc thu băng hình, còn việc khai như vậy là có ông Cao Văn Hùng đứng đằng sau nhắc cho Lâm khai.
Vấn đề tang vật, luật sư cho rằng tang vật vụ án này là tang vật giả, không phải là con dao phay mà chỉ là miếng sắt gỉ. Mẫu vật này được gửi đi giám định, ngày 26-6-2002 tại Công văn số 29, Đại tá Phạm Ngọc Hiền, Phó Viện trưởng Viện Kĩ thuật hình sự kiêm Phân Viện trưởng Viện Khoa học hình sự Bộ CA trả lời: Về mức độ sét gỉ tan rã của con dao phay và mức độ phân hủy của chất liệu giấy xi măng chôn ở độ sâu ẩm ướt, hiện nay chưa có tài liệu khoa học nào đề cập và chưa có tác giả nào nghiên cứu. Do đó, không trả lời được.
TAND tỉnh Bình Thuận vẫn tuyên bố: Các bị cáo Nguyễn Thị Lâm, Nguyễn Văn Sơn, Nguyễn Văn Tiền, Nguyễn Thị Tiến, Huỳnh Văn Nén phạm tội: “Giết người”.
– Cán bộ điều tra tố Luật sư.
Ngày 5-8-2004, nguyên điều tra viên Cao Văn Hùng đã tố cáo các luật sư có hành vi phạm tội vu khống và làm nhục người khác. Trong đơn tố cáo dày 6 trang A4, ông Cao Văn Hùng đã viết: “Trong thời gian diễn ra phiên tòa, 3 luật sư Phạm Hồng Hải, Trần Vũ Hải, Bùi Đức Trường liên tục có những lời lẽ, cử chỉ, hành động làm nhục, đồng thời tố cáo cá nhân tôi thực hiện hành vi “Làm sai lệch hồ sơ vụ án” và họ đã có đơn đề nghị các cơ quan tiến hành tố tụng tỉnh Bình Thuận khởi tố vụ án đối với cá nhân tôi”. Ông Cao Văn Hùng khẳng định: “8 vấn đề mà luật sư dùng làm căn cứ buộc tội tôi là không đúng sự thật. Nhưng do muốn che giấu tội lỗi cho thân chủ của mình, các luật sư đã lợi dụng những thiếu sót về thủ tục tố tụng rồi phân tích, đánh giá không khách quan về vụ án, qua đó các luật sư cố tình tung ra tài liệu, chứng cứ không đúng sự thật, rồi gán ghép cho tôi thực hiện hành vi làm sai lệch hồ sơ vụ án và đề nghị khởi tố tôi… trong lúc phiên tòa chưa kết thúc và cũng chưa có một kết luận chính thức nào của cơ quan chức năng”. Trong đơn, ông Cao Văn Hùng còn tố cáo các luật sư“xúc phạm đời tư của nhiều nhân chứng khác, xúc phạm đến các cơ quan tiến hành tố tụng tỉnh Bình Thuận”
Ông Hùng cho rằng các hành vi của 3 luật sư trên đã gây ra dư luận cực kì xấu xa về ông, làm cho vợ con ông rất hoang mang lo sợ, ảnh hưởng nghiêm trọng đến đời sống và tinh thần của ông và gia đình. Con cái ông đến trường bị bạn bè xa lánh, vợ ông bị nhiều người nói mỉa mai, khinh miệt… cá nhân ông đi ra đường bị nhiều người xôn xao, bàn tán, gây nhiều khó khăn trong đi lại làm ăn.
Ông Hùng cảm thấy lòng tự trọng, uy tín danh dự nhân phẩm của ông đã bị xâm phạm nghiêm trọng, ảnh hưởng đến cuộc sống, hành hạ tinh thần cho gia đình và cá nhân ông trước mắt cũng như lâu dài.
Từ những viện dẫn nêu trên, ông Cao Văn Hùng đã đề nghị cơ quan tố tụng Bình Thuận xem xét khởi tố về hành vi vu khống và làm nhục người khác của các luật sư… buộc bồi thường thiệt hại vật chất và tinh thần cho gia đình ông.
– Đại diện VKS cũng chỉ trích các luật sư.
Tại phiên tòa, trong phần tranh tụng, đại diện viện kiểm sát đã nêu ra những sai phạm của các luật sư tham gia bào chữa. Theo VKS, các luật sư đã sử dụng những ngôn từ gây sốc, có tính chất mỉa mai, thách đố, có ý đồ kích động, thậm chí là quảng cáo “thương hiệu” như đưa ra các thông tin từng bào chữa cho Phạm Sỹ Chiến trong vụ án Năm Cam.
Đại diện VKS cũng cho rằng luật sư đã vi phạm quy tắc về đạo đức nghề nghiệp trong ứng xử, không tuân thủ sự điều hành của chủ tọa phiên toà, thể hiện ở chỗ, có lần phát biểu cắt ngang lời đại diện VKS và không chịu ngồi xuống khi chủ tọa yêu cầu.
Đại diện VKS cũng khẳng định, luật sư đã xúc phạm nghiêm trọng đến uy tín, danh dự, nhân phẩm của nguyên ĐTV Cao Văn Hùng, khi cho rằng Cao Văn Hùng là một ĐTV yếu năng lực, kém đạo đức nhưng cực kì thủ đoạn và gian manh.
Thế nhưng, khi các cơ quan chức năng vào cuộc xác minh đơn thư tố cáo, cùng với thực tế diễn biến vụ án sau đó đã chứng minh rằng các luật sư không sai.
* KẾT CỤC CUỐI CÙNG CỦA VỤ ÁN
– Trả tự do
Tại hai lần phiên tòa xử phúc thẩm của Tòa phúc thẩm TAND Tối cao tại TP. HCM đều tuyên hủy án để điều tra lại vì chưa đủ căn cứ buộc tội các bị cáo.
Tại Bản án số 302/HSPT, từ ngày 9 đến 11-3-2005, Tòa phúc thẩm TAND Tối cao đề nghị Cơ quan CSĐT điều tra lại vụ án. Có thể nói mỗi phiên tòa là một cuộc tranh cãi gay gắt giữa luật sư của các bị cáo với cơ quan công tố. Những thiếu sót của các cơ quan tố tụng trong quá trình điều tra, đưa vụ án ra xét xử, vì thế “Vụ án vườn điều” đã nhanh chóng trở thành bức xúc trong dư luận.
Lãnh đạo Bộ CA đã chỉ đạo Tổng cục Cảnh sát thành lập Ban chỉ đạo điều tra lại vụ án do Thiếu tướng Phạm Nam Tào, Phó Tổng cục trưởng Tổng cục Cảnh sát làm Trưởng ban; giao cho Cục CSĐTTP về TTXH chủ trì phối hợp các đơn vị nghiệp vụ CA tỉnh Bình Thuận điều tra lại toàn diện vụ án. Ban chỉ đạo điều tra vụ án đã cử những điều tra viên có kinh nghiệm nhất vào cuộc với yêu cầu phải hết sức khách quan, thận trọng. Viện KSND Tối cao cũng đã cử 2 kiểm sát viên cao cấp là những người chưa hề biết đến “Vụ án vườn điều” xem xét lại toàn bộ hồ sơ vụ án, các phương tiện khoa học kỹ thuật hiện đại nhất tại thời điểm đó cũng được sử dụng cho công tác giám định pháp y. Việc điều tra lại vụ án quả thực là cực kỳ khó khăn. Thời gian của vụ án diễn ra đã quá lâu; nhân chứng, vật chứng cũng bị thay đổi nhiều. Trong số nhân chứng và cán bộ CA tham gia điều tra vụ án trước đây thì 10 người đã mất. Vụ án đã được xét xử qua 4 lần, cho nên công tác trinh sát thu thập tài liệu cũng như đấu tranh với các bị cáo là điều không thể. Tuy vậy, qua gần một năm điều tra lại nghiêm túc, cẩn trọng, Cơ quan CSĐT của Bộ CA đã làm rõ được 5 yêu cầu mà Tòa phúc thẩm đặt ra.
5 yêu cầu đó là: Giám định con dao gây án; thời gian chết của nạn nhân và nguyên nhân gây ra cái chết; tại sao trên hiện trường lại có nhiều mẩu thuốc lá Everet; lá thư của Trần Thị Kim Yến viết hộ Dương Thị Mỹ hẹn hò với Trần Văn Sáng; thời gian ngoại phạm của bị cáo Huỳnh Văn Nén…
– Về con dao, sau 5 năm chôn dưới đất (từ năm 1993 – 1998), Cơ quan CSĐT đã trưng cầu Viện Khoa học hình sự phối hợp với Viện Hóa học, Viện Khoa học và Công nghệ quốc gia, Viện Công nghệ và Trung tâm tiêu chuẩn đo lường I… nhưng các cơ quan này từ chối giám định, bởi vì những mảnh kim loại đã gỉ sét “được coi là con dao” bị gãy vỡ không đủ điều kiện để xác định chủng loại gang hay thép. Nhưng thực tế thì đây khó có thể là con dao gây án.
– Về việc thời gian nạn nhân bị chết và nguyên nhân gây ra cái chết thì CQĐT đã tiến hành khai quật, giám định hài cốt của Viện Khoa học hình sự, Bộ CA kết hợp với kết quả giám định pháp y của Tổ chức Giám định pháp y Bình Thuận; đồng thời trưng cầu giám định ADN giữa mẫu xương của nạn nhân với mẫu máu, tóc các con ruột bà Dương Thị Mỹ. Kết quả cho thấy, tử thi bị giết phát hiện ngày 21-5-1993 tại vườn điều nhà ông Hai Hoàng chính là bà Dương Thị Mỹ. Thời gian chết của nạn nhân cho đến lúc phát hiện được trong khoảng từ 48 – 72 giờ (3 ngày). Mức độ phát triển của giòi, bọ trên xác nạn nhân phù hợp với thời gian khoảng 60 giờ sau chết. Bà Mỹ đã bị đánh, còn nguyên nhân cái chết thì bà đã bị đánh bằng gậy và bị chém bằng 2 loại dao, các vết thương gây trên người nạn nhân là dao quắm. Còn loại dao như Huỳnh Văn Nén khai là dao phay chỉ có thể gây nên một số vết thương trên người nạn nhân.

– Về lời khai của nhân chứng Trần Thị Kim Yến là người đã viết hộ bà Mỹ đơn xin ly dị chồng và viết thư cho Mỹ hẹn gặp anh Sáng thì lời khai của chị Yến đã khác nhiều so với các lần trước. Tóm lại, lời khai của nhân chứng Trần Thị Kim Yến ở các thời điểm khai báo đều không thống nhất, luôn thay đổi, mâu thuẫn về thời gian, do vậy không đảm bảo yếu tố khách quan. Trong quá trình điều tra, CQĐT còn trưng cầu Viện Khoa học hình sự tổ chức giám định pháp y sinh vật để giám định các dấu vết, thương tích và cơ chế hình thành thương tích trên người nạn nhân. Căn cứ vào biên bản khám nghiệm tử thi ngày 21-3-1993 của CA Bình Thuận, kết hợp với dấu tích trên xương khi khai quật, giám định hài cốt ngày 22-6-2005, xác định trên cơ thể bà Mỹ có các loại tổn thương sau: Tổn thương do vật tày gây ra, các tổn thương do vật sắc nhọn. Nhiều khả năng vật sắc nhọn đó chính là mũi dao quắm.
Ngày 21-12-2005, Bộ CA, VKSND Tối cao và một số đơn vị tố tụng liên quan đã tổ chức cuộc họp về hướng xử lý vụ án Vườn Điều (xảy ra tại Bình Thuận). Các cơ quan pháp luật thống nhất phương án: VKSND Tối cao ra quyết định tạm đình chỉ điều tra vụ án, đình chỉ điều tra bị can vì không tìm được chứng cứ để buộc tội. Như vậy, các bị can sẽ được trả tự do. Riêng Huỳnh Văn Nén tiếp tục thụ án do phạm tội trong một vụ án khác.

Sáng 20-1/2006, tại trụ sở UBND thị trấn Tân Minh, huyện Hàm Tân, đại diện lãnh đạo CA, VKSND và TAND tỉnh Bình Thuận đã tiến hành xin lỗi công khai các công dân bị oan sai trong vụ án “vườn điều” xảy ra ở địa phương này từ cuối tháng 5-1993. Như vậy, 8 thành viên trong gia đình bà Nguyễn Thị Lâm đã bị Cơ quan CSĐT CA Bình Thuận,Viện KSND và TAND tỉnh Bình Thuận điều tra, truy tố, xét xử oan sai, làm nhiều người phải ngồi tù oan trong nhiều năm chính thức được minh oan.
* Tâm sự của Thẩm phán xét xử vụ án .
Thẩm phán Quảng Đức Tuyên Phó Chánh toà phúc thẩm TANDTC tại TP.HCM thành viên HĐXX phúc thẩm vụ án “vườn điều” kể về những phân vân của HĐXX phúc thẩm khi nghiên cứu hồ sơ vụ án: Những bằng chứng mà các cơ quan pháp luật ở Bình Thuận buộc tội cho các bị cáo không đủ sức thuyết phục. HĐXX rất phân vân về việc phá án dựa vào lời khai của bị cáo Nén là một người đang bị sức ép căng thẳng của hình phạt tù chung thân do phạm tội giết người cướp tài sản, đang hy vọng tìm cách “lập công” để giảm hình phạt. Con dao phay mà bị cáo Nén khai đã sử dụng trong vụ đánh ghen, sau đó bọc giấy xi măng rất kỹ và đem chôn, khi giám định chỉ là một “vật cứng dạng kim loại gỉ sét có chứa thành phần chính là sắt”; Hay việc mô tả quá kỹ lưỡng, chi tiết vụ đánh ghen diễn ra trong một đêm tối trời không trăng sao, nơi đánh ghen lại là trong vườn điều dày tán; Vụ đánh ghen đông người tham gia xảy ra chỉ cách khu dân cư khoảng 30 mét nhưng không một ai hay biết cho đến lúc xác chết đã thối rữa. Nhiều chứng cứ ngoại phạm của các bị cáo không được cơ quan pháp luật ở Bình Thuận làm rõ.
* Bồi thường:
Ngày 6/11/2006 , 4 công dân bị kết án tù oan 24 năm trong vụ án “Vườn điều” là bà Nguyễn Thị Lâm và 3 con ruột gồm Nguyễn Văn Châu, Nguyễn Văn Tiền, Nguyễn Thị Tiến đã đến Kho bạc Nhà nước tỉnh Bình Thuận nhận hơn 935 triệu đồng được chuyển đến từ tài khoản của TAND tỉnh Bình Thuận. Đây là số tiền họ được nhận bồi thường về thiệt hại tinh thần và mất thu nhập theo Nghị quyết 388 của Ủy ban Thường vụ Quốc hội. Về tổn thất tinh thần, một ngày bị giam oan sẽ nhận đền bù bằng 3 ngày lương tối thiểu; riêng đền bù mất thu nhập thương lượng theo điều kiện của mỗi người. Cụ thể bà Lâm bị giam oan 7 năm nhận hai khoản được 202 triệu đồng; chị Tiến bị giam oan 5 năm được bồi thường hơn 177 triệu đồng; anh Tiền nhận 266 triệu, anh Châu nhận 288 triệu đồng. Sau khi nhận bồi thường, cả bốn người bị oan đều cho biết sẽ khiếu nại do thời điểm thoả thuận là tháng 6/2006, lúc đó lương cơ bản chỉ 350 ngàn đồng/ tháng, khi nhận tiền đã đến tháng 11 và lương cơ bản cũng đã tăng lên 450 ngàn đồng/tháng. Theo tính toán của họ, số tiền mà 4 người bị thiệt hại gần 120 triệu đồng.
Tính cho đến nay ( tháng 1/2007), các cơ quan tố tụng của tỉnh đã bồi thường gần 1,2 tỉ đồng cho những người trong một gia đình bà Nguyễn Thị Lâm của “kỳ án vườn điều”.
* Hệ lụy.
“ Kỳ án vườn điều vẫn được nhắc đến trong các cuộc tọa đàm của ngành tư pháp và xem như là một bài học đắt giá cho các cơ quan tiến hành tố tụng”. Khi nhắc lại “vụ án vườn điều” mỗi chúng ta không ngoài mong muốn sẽ không còn có những vụ án “lịch sử” như vụ này. Nước mắt và… nước mắt.
Trong căn nhà nhỏ ở khu phố 3 thị trấn Tân Minh, ông Nguyễn Văn Gấm ngồi thẫn thờ nhìn ra cửa. Ông đang chờ mong đến giờ phút được thấy vợ ông – bà Nguyễn Thị Lâm- bước chân vào nhà. Bà Lâm năm nay đã 68 tuổi, bị quy là người trực tiếp giết bà Dương Thị Mỹ, đến ngày 21/12/2005 mới mãn hạn 7 năm tù giam. Vẫn đang trong trại giam, có lẽ bà là người duy nhất của gia đình chưa biết tin vui. Nhưng bà còn có diễm phúc hơn con gái đầu của mình là Nguyễn Thị Nhung, di ảnh của chị đang được đặt trên một bàn thờ nhỏ cạnh bàn thờ ông bà tổ tiên. Chị Nhung chết vì ung thư năm 2001, sau hơn 3 năm bị tạm giam. Thấy chúng tôi đến thăm, ông Năm Gấm thắp hương trên 2 bàn thờ, mắt rân rấn nước. Các con cháu ông lục tục kéo đến. Nguyễn Thị Tiến ôm di ảnh chị ruột khóc nức nở: “Chị ơi, gia đình mình chờ đợi ngày này đã lâu, nay nó đến thì chị đâu còn nữa!”. Đứng bên dì ruột trước bàn thờ mẹ mình, Trần Thanh Vân và Trần Thanh An cũng giàn giụa nước mắt. Trong ánh mắt hàng chục đứa trẻ vô tội như còn dấu vết những tháng ngày tủi nhục, vất vưởng, thất học, bữa đói bữa no vì đại gia đình của chúng lâm cảnh tai ương. Mãn hạn tù đầu năm nay, Tiến lủi thủi kiếm sống bằng hàng bún riêu ở chợ, trước đó hai con nhỏ được chính quyền xã giúp gửi vào Làng SOS Gò Vấp, con lớn theo cha sống ở xa. Trong tù, Nguyễn Văn Tiền tưởng chừng không qua khỏi vì bệnh tật, thêm nỗi đau vợ bỏ lấy chồng khác, hai con đứa 5 đứa 7 tuổi (lúc Tiền bị bắt) lưu lạc tận Quế Sơn – Quảng Nam. Bé Dung, con lớn của Tiền khóc: “Ngày đó con đi chăn bò, khổ lắm…”. Nay ba cha con Tiền tá túc ở nhà chị ruột, làm thuê mướn sống qua ngày. Nguyễn Văn Sơn có xe cải tiến chở hàng thuê, 3 con đều học giỏi. Gia đình đang êm ấm thì tai họa ập đến: 3 tháng sau ngày vợ mất vì tai nạn giao thông, Sơn bị bắt. Các con Sơn phải nghỉ học, đứa bán vé số, đứa làm thuê, đứa vào Làng SOS. ở một góc hẻo lánh của thị trấn Tân Minh có một căn nhà thấp nhỏ lợp tôn do bà con góp tâm góp của xây dựng cho 3 đứa con của Nguyễn Thị Cẩm và Huỳnh Văn Nén trên đất chính quyền cấp không thu tiền.
Nén đang thụ án tù chung thân vì vụ án bà, sau khi được miễn truy tố, Cẩm đi làm thuê tận Bình Dương. Đứa con út của họ được một người ở xã bên nhận làm con nuôi, 2 đứa lớn mới mười mấy tuổi đầu phải tự kiếm miếng ăn…
